Please google “blm fist”, click images. You will not find one that matches my design anywhere in the results.

I understand the concern over the similarity between our design and that of Black Lives Matter from a legal standpoint. And though the point is moot, I want to say for the record that the fist, even the “official” one which is different from ours, is not trademarked. It does not appear on the Black Lives Matter website (https://blacklivesmatter.com/) and is not on their official merchandise. But rather than continue to argue the point we’d like to substantially change our design if that’s allowed.

The design is clearly not trademarked or used officially by Black Lives Matter on their website or merchandise, but I think this is a battle I am not going to win. I’m only getting one answer from the committee. Black Lives Matter can’t give me permission to use a design that they don’t own, so what they are asking me for is impossible to provide.

Hey @Bitjamins! This is not a battle, please don’t take it like that. We only need to be sure that the icon is free to use, for you and your costumers.

Ok, I understand the legal concerns. I asked several questions and I only received exactly the same message in response, So I’m starting to feel like what I’m asking is not being directly addressed. The link you sent has no information re: the logo/icon for BLM or any copyrights or trademarks. I did some research before I submitted the design and as far as I’m aware this logo/icon is not trademarked or copyrighted. I have been on the BLM site numerous times over a period of years. This logo is not on their site or on any of their merchandise. Other merchants are selling merchandise with a “BLM” black fist icon on it online. So it is clearly not their trademark because it would be stated on their site. I don’t know what else I can do to prove this is the case. As I said above, I cannot ask them for permission to use a logo they don’t own.

Thanks for the reference to the previous case. I took a look at it. I believe our case is different because we are not using the text “Black Lives Matter” on our design. Our design, though similar, is not a direct copy of the BLM fist, which is public domain. And it is not cultural approbation because I am black. We would certainly be open to donating a portion of the profits to a legitimate charity focused on black political and cultural issues.

Once again, we emailed legal@decentraland.org as you requested, almost a week ago, and our design remains “Under Review”. Is someone going to answer us. It’s been 7 days since we received any kind of response.

Give them time…Mine has taken 2 months. Also yours is tricky because i as a user see your logo and i immediately think the BLM organization. These are some legal waters i would not even dare to thread oof. Good luck to you! :smiley:

We were given no answer and no expectation of the amount of time it takes. Really how hard is it to simply respond to a question within the span of a week? I believe I read in the docs that a reasonable expectation was 3 to 5 days. Two months for approval seems like an inordinate amount of time. I thank you for your legal assessment. It’s much appreciated.
