# Proposal: Probate process

**Status** : DRAFT

**Summary** :  
This proposal aims to standardize the way a user can request Decentraland DAO to transfer ownership of all LAND and STATE from one account to another.

**Abstract** :  
A user starts by presenting her case to the DAO’s community using our forum to gather feedback. Then she opens a proposal using our governance dapp by providing the address to collect LAND and STATES from and paying a fee of 1000 MANA.

The proposal will follow our [community voting guidelines](https://docs.decentraland.org/decentraland/community-voting/). When the proposal is enacted it will transfer ownership of all LAND and STATE owned by the first account to the one paying the fee.

**Motivation** :  
Private keys will be lost. If enough proof is presented to the DAO the rightful owner should gain access to her non-fungible tokens. See [Ethen’s case](https://forum.decentraland.org/t/vote-yes-to-return-lost-land-and-set-the-precedent-for-this-moving-forward/296) as the first example.

**Specification** :  
Update the [LAND](https://github.com/decentraland/land/blob/master/contracts/land/LANDRegistry.sol) and [ESTATE](https://github.com/decentraland/land/blob/master/contracts/estate/EstateRegistry.sol) smart contracts to allow the DAO to change the owner of a property. Also, update the [governance’s UI](https://github.com/decentraland/governance) to allow users to create a new type of proposal under the name “Initiate Probate”.

**For** :
